TERMS AND CONDITIONS 

General Terms and Conditions of Delivery and Payment of FTDS Door Service Company.

 

Hereby disclaims all warranties, either express or implied, including any implied warranty of merchantability or fitness for a particular purpose. Any statement contained herein does apply where prohibited by law.

 

In these terms and conditions of delivery and payment of FTDS Door Service Company (hereafter: the “Conditions of Sale”) the following terms have the following meaning:

SERVICES:

Services provided by FTDS Door Service Company are for steel doors, wood doors, and glass doors. All work and services to be provided are the subject matter of an agreement.

GUARANTEE PERIOD:

All work orders and invoices are charged with a service call and hourly labor. Customers may request regular service, same-day service, and/or emergency service at the required applied rate.


Warranties all materials for replacement only 120 days.

All electronics 90 days warranties only. 

Estimate:

Estimate prices are good for 30 days after the above date of the Work order number.

All material is guaranteed to be as specified, and the above work is to be performed in accordance with the drawing and specifications with a 50% down payment and remainder due upon completion.

 

Note: Proposal may be withdrawn by FTDS Door Service Company, LLC. if not accepted within 30 days.

 

CLIENT:

Every natural person or legal entity entering into an agreement with FTDS Door Service Company


The client shall not be entitled to recover from FTDS Door Service Company. Any Consequential damages, damages to property, damages for loss of time, loss of profit, or income, or other incidental damages. 

ORDER:

The order from the Client to FTDS Door Service Company for the delivery of a product or service;


Once an order is made a signed copy of a service call request form will be printed and used as the customer’s acceptance of FTDS Door Service Company rates and bill guidelines and must be on file before work is performed.

AGREEMENT:

i. Every agreement effected between FTDS Door Service Company, LLC and the Client regarding the delivery by FTDS Door Service Company, LLC of Products or Services to the Client, as well as every amendment or addition to such and all (legal) acts necessary for the entering into or the performance of that agreement;


ii. Work order terms shall be governed by the laws of the jurisdiction in which the provider performs services;


iii. Terms shall be valid and enforceable to the fullest extent allowed by such law;


iv. Terms shall be hiding upon and inure to the benefit of, the parties and their permitted respective successors and assigns.


v. Any express waiver or failure to exercise promptly any right under these terms will not create a continuing waiver or any expectation of non-enforcement.


vi. A party is not liable under this agreement for any breaches caused by events or conditions beyond that party’s control, provide the party makes reasonable efforts to perform its obligations or cure the breach under the entire agreement of provider and user regarding the services to be provided pursuant to such work order or invoice.


vii. The terms of these work orders or invoice terms which by their nature are intended to survive the completion of the services by providing and termination of the work order or invoice, shall survive such completion and termination.


VIII. This invoice shall not be subject to any rule requiring construction against the drafter hereof.

The fact that one of the parties may have drafted or structured any provision of this invoice or any document attached as an exhibit hereto shall not be considered in construing the particular provision either in favor or against such party.


IX. Invoice shall be interpreted and construed in accordance with the laws of the State of Florida.


PERFORMANCE:

The products and services to be delivered by FTDS Door Service Company.

PRODUCTS:

All the goods and the user rights to those goods that are the subject matter of an Agreement.

PAYMENT

1. All new and existing customers who do not have an account with FTDS Door Service Company must arrange payment before the dispatching of a technician.


2. All work order is charged a service call. 


3. Hourly rate begins when the technician arrives at the Customer’s place of business.


4. Labor in excess of one hour is billed in 15 minutes increments.


5. We accept cash, check, Master Card, Visa, Discover, and American Express. 


6. Your permission to use your credit card for COD payment is required to schedule an appointment, by giving us your credit card number, you are authorizing us to charge your account and agreeing to our terms and conditions



7. The credit card will be pre-authorized when your appointment is scheduled with the minimum amount due. Pre-authorization will hold funds on debit cards and may show as “in process” but is not charged on the debit or credit cards until completion of the service call and final auditing by our technician and customer service manager.


8. Any past due invoices are charged a late fee.


9. All parts remain FTDS Door Service Company property until invoices are paid in full.  If the buyer fails to pay the invoice. FTDS Door Service Company technicians are authorized to remove any hardware, glass, and door specified on the invoice without the client's consent if the invoice is not paid entirely. 


10. If any of the parties seek to enforce the payment terms of the invoice, the prevailing party shall recover from the non-prevailing party all costs and expenses, including, without limitation, attorney's fees and costs, incurred by the prevailing party. The attorney fees to be recovered pursuant to this provision shall be limited to enforcement, by either party, of payment terms only, and the attorney's fee shall not be awarded for any other enforcement action relating in any way to this invoice or service or parts described herein. 


Automatic Door Safety Check



Please complete the following each day to ensure your automatic doors are safe. It's best to stop accidents before they happen through proper routine safety checks.


1. Walk toward the door at a normal pace, the door should open before you reach the threshold. 


2. Stand motionless in the threshold for 10 seconds. The door should not close. If using a swinging automatic, walk past the threshold into the swing area and stop for 10 seconds. The door should not close. If you have a folding automatic, walk past and stand in the folding area for at least 10 seconds. The door should remain open.


3. Move clear of the area. The door should remain open for at least 2 seconds and should close slowly and smoothly.

4. Inspect the threshold area. It should be clean with no loose parts that might cause someone to trip or fall. Keep traffic path clear. 


5. Inspect the glass, safety decals, guide, and finger guards. All should be present and in good condition. ( Guide rails and finger guards on folding/ swinging Automatic doors only. 


6. Repeat steps 1-5 from opposite directions in a two-way door. 


7. HAve your door inspected by FTDS Door Service Company, LLC. The technician at least once a year.  Call 1-855-791-6898 to make an appointment for your inspection.

If the door fails any of the above or malfunctions in any way, stop using the door and call a door repair technician immediately.
